Wills, lasting powers of attorney & advance healthcare directives

Carefully planned and, above all, timely estate and provision arrangements and estate planning are crucial in order to secure personal wishes and ideas regarding one’s own twilight years and afterwards and to prevent family conflicts.

With a customised will, you can regulate the distribution of your assets and determine the beneficiaries of your estate. A properly set up will gives you the opportunity to sufficiently address statutory shares, favour certain people and give clear instructions for the distribution of your estate. We advise our clients on the drafting of wills and ensure that they correspond to your personal wishes and fulfil all legal requirements. We are also happy to register your will in the official Register of Wills of Austrian lawyers.

It is equally important to timely make provisions for the event that you are no longer able to manage your own affairs. With a lasting power of attorney, you appoint one or more trusted persons to represent you in financial, medical and/or personal matters. In addition, or as an alternative, an advance healthcare directive allows you to make your wishes regarding medical treatment binding and thus ensure that they are respected even in difficult situations. We assist our clients in drafting the appropriate documents, clarify their legal implications and ensure that they are formulated in a legally binding manner.

  • Will
With a will, our clients can determine during their lifetime who should inherit their assets after their death and how the distribution of the estate should be organised in detail. We advise on the drafting of legally binding wills in order to realise individual wishes and avoid or prevent disputes between heirs.

  • Legacy
A legacy is a bequest of a specific item or asset to someone who is not an heir without that person becoming an heir. Our clients use legacies to organise personal bequests outside of the statutory succession – we help them to precisely formulate and secure these wishes.

  • Lasting power of attorney
With a lasting power of attorney, our clients appoint one or more trusted persons to represent them in the event of incapacity. We help with the comprehensive drafting and draft in legally binding language to ensure that all relevant areas of life (medical, financial and personal matters) are covered and official intervention is avoided.

  • Advance healthcare directive
An advance healthcare directive makes it possible to determine in advance which medical treatments are desired or rejected. Our clients receive personalised advice on how to formulate this sensitive directive in a legally clear and precise manner, thus preserving their self-determination even in critical health situations.

  • Register of wills
The official Will Register maintained by the Austrian Bar Association ensures that wills can be found and taken into account in the event of death. We advise our clients on the registration of their wills so that they can be found and presented reliably and in good time.

  • Statutory share
The statutory share protects close relatives such as children and spouses and guarantees them a statutory minimum entitlement to the estate – even if they were not included in the will. We advise on claims to a statutory share and assist with the legally binding drafting of wills.

  • Event of incapacity
An event of incapacity occurs when a person can no longer manage their own affairs due to illness, accident or old age. We advise our clients on timely protection through precautionary documents such as lasting powers of attorney and advance healthcare directives in order to protect their interests in such situations and avoid official interventions.
