Late, but still Austria wants to introduce a genuine class action. With completely new possibilities. An analysis.
The Representative Actions Directive (EU) 2020/1828 obliges member states to introduce a genuine class action for consumers. Around a year and a half after the transposition deadline (and one infringement procedure later), the Ministry of Justice has now presented a draft law (“Die Presse” reported). The centrepiece is the so-called redress action, a genuine collective action by consumers against companies for performance in the form of damages, repair, compensation, price reduction, contract cancellation or reimbursement.
